Real Estate Law
Our real estate practice covers all aspects of property ownership on Cape Cod. We work with first-time homeowners, those purchasing and selling vacation residences as well as commercial developers in all facets of property ownership, permitting and development. 

The nature of life on the Cape presents title issues ranging from sanding rights in properties abutting cranberry bogs to the rights of parties in ancient cartways. We are also often faced with more current questions as to the applicability of subdivision rules and regulations and the rights of individuals to use association beaches and other such amenities. Our decades of experience provide our clients with practical solutions in addressing complex title issues.  As agents for First American Title Insurance, we often work with underwriting counsel at First American, when appropriate, to address any such complexities with title insurance.

We have broad experience in zoning matters and are frequently involved in permitting residential and commercial projects. We are experienced in the regulatory process associated with Cape Cod Commission review.  Our firm works with a variety of residential and commercial lenders to assist our clients in financing the acquisition and development of properties. We also have experience with nonprofit development of real estate and permitting matters unique to nonprofits. 

Estate Planning, Elder Law and Estate Administration. 
Cape Cod is a retirement community for many. It is also a place where entrepreneurs provide the majority of the services and goods necessary to keep the economy growing. We assist individuals across this broad spectrum with estate planning designed to meet their needs and to preserve their assets for future generations. 

Our estate planning practice includes planning for those with complex requirements, such as the creation of supplemental needs trusts for individuals with disabilities, Medicaid planning, marital trust planning for those with significant net worth, as well as estate planning for those with more basic needs. We often work with other professionals including accountants, investment and insurance advisors to help clients create a comprehensive estate plan. We counsel individuals as to the use of health care proxies, durable powers of attorney, wills and trusts and homestead protection. We can assist your family to maintain your Cape Cod family residence for future generations.  Where appropriate, we assist in the area of business succession planning for clients, ensuring that their families recognize the value of the businesses after the death of the founder.

Our practice includes estate and trust administration. We assist families on Cape Cod and beyond in dealing with simple and complex administrations, guiding families through the complexities of the probate process cost-effectively and expeditiously. From time to time, we are appointed by the Barnstable County Probate Court in circumstances where families require assistance in working through unresolved issues after a loved one’s death, or when a family is in need of a conservator or trustee.

Business Law
The backbone of Cape Cod’s economy is small business. We are privileged to work with many small to medium-sized business owners and operators and we consider ourselves partners in their success.  From the creation of business entities to mergers and acquisitions of ongoing businesses, we work with business owners to help them reach their goals in economical and conservative ways.

Non-profit Law
Given the active roles many Cape Cod residents take in their communities, it should be no surprise that Cape Cod and the Islands are replete with non-profits working every day to make our Communities better places.

Our experience in nonprofit law allows us to provide representation in a range of non-profit legal matters unique to a firm of our size. We frequently work with non-profits on real estate matters in connection with permitting. We work with officers and directors of non-profits to resolve employee issues, business disputes, and to secure recognition of non-profits as tax exempt entities by the Internal Revenue Service.  The compliance issues facing non-profits at both the state and federal level can be complex. We have the knowledge and the ability to help our non-profit clients navigate this complex regulatory framework in order to achieve their goals.

Alternative Dispute Resolution
Solutions are our goal. Unfortunately, in some instances parties are too far apart to find common ground. Attorney Jeffrey W. Oppenheim has been a mediator for over twenty years and is a conciliator appointed by the Barnstable County Probate Court. Both Attorneys Oppenheim and Nickerson work with clients to attempt to resolve disputes without resorting to litigation through avenues such as mediation or arbitration.
